Terms and Conditions
Please read these terms carefully before booking with Landscape Adventure. By confirming a booking, you agree to these terms.
1. Introduction
These Terms and Conditions govern the relationship between you ("the Client," "Traveler," or "you") and Landscape Adventure Pvt. Ltd. ("the Company," "we," "our," or "us"), a trekking and tour agency registered in Nepal. By confirming a booking with us, you acknowledge that you have read, understood, and agreed to be bound by these terms.
2. Booking & Confirmation
A booking is considered confirmed only upon receipt of the required deposit (30% of the total trip cost) and a completed booking form. The remaining balance must be paid at least 30 days before the departure date. For bookings made within 30 days of departure, full payment is required at the time of booking.
All bookings are subject to availability. We reserve the right to decline a booking if the trip is fully booked or if we determine that the traveler's fitness or health conditions may pose a safety risk.
3. Pricing & Payments
- All prices are quoted in US Dollars (USD) unless otherwise stated.
- Prices are based on current costs and exchange rates, which may fluctuate. We reserve the right to adjust prices in the event of significant currency changes, fuel surcharges, or government-imposed taxes.
- A 3% processing fee applies to credit/debit card payments.
- Accepted payment methods include credit/debit card, bank transfer, PayPal, Wise, and cash at our office.
4. Cancellation & Refund
Cancellations are subject to our Cancellation & Refund Policy. Please refer to that page for detailed information on cancellation charges, refund timelines, and trip modification procedures.
5. Travel Documents & Requirements
- It is the traveler's responsibility to ensure valid travel documents, including a passport with at least 6 months validity from the date of entry into Nepal.
- We will assist with trekking permits and national park entry fees as included in your package. Costs for these permits are included in the quoted price unless stated otherwise.
- Visa fees are not included in the trip cost. Nepal offers visa on arrival for most nationalities at Tribhuvan International Airport.
- It is your responsibility to check visa requirements for your nationality before travel.
6. Health & Fitness
Trekking and mountaineering in the Himalayas involve physical exertion at high altitudes. By booking with us, you confirm that:
- You are in good physical health and fit enough to undertake the chosen trip.
- You have disclosed any pre-existing medical conditions, allergies, or medications to us before departure.
- You understand the risks associated with high-altitude travel, including acute mountain sickness (AMS).
- You agree to follow the instructions of your trek leader regarding acclimatization, rest days, and safety decisions.
7. Travel Insurance
Comprehensive travel insurance is mandatory for all travelers. Your insurance policy must cover:
- Emergency medical treatment and hospitalization.
- Helicopter evacuation and rescue at high altitude (minimum coverage of USD 100,000).
- Trip cancellation and interruption.
- Loss or delay of baggage.
You must carry proof of insurance during the trip. Landscape Adventure reserves the right to refuse participation to any traveler without adequate insurance coverage.
8. Our Responsibilities
Landscape Adventure will:
- Provide experienced, licensed guides and support staff for all trips.
- Arrange all accommodations, meals, transport, and permits as described in the itinerary.
- Prioritize your safety at all times and make decisions accordingly.
- Provide 24/7 emergency support during your trip.
9. Limitation of Liability
While we take every precaution to ensure your safety and comfort, Landscape Adventure shall not be liable for:
- Injuries, illness, death, loss, or damage arising from inherent risks of trekking, mountaineering, and adventure travel.
- Delays or changes caused by weather, natural disasters, flight cancellations, road conditions, political situations, or other events beyond our control.
- Loss or damage to personal belongings during the trip.
- Actions or omissions of third-party service providers (airlines, hotels, transport operators).
10. Itinerary Changes
Published itineraries are planned carefully but are subject to change due to weather, trail conditions, road closures, or other circumstances. Our guides reserve the right to modify the route or schedule to ensure the safety of all participants. No refund is provided for unused services due to itinerary changes made for safety reasons.
11. Code of Conduct
Travelers are expected to:
- Respect local customs, cultures, and traditions.
- Follow the instructions of guides and trek leaders.
- Minimize environmental impact and follow Leave No Trace principles.
- Treat fellow travelers, staff, and local communities with respect.
We reserve the right to remove any traveler from a trip without refund if their behavior endangers themselves, others, or the environment.
12. Photography & Media
By joining our trips, you consent to photographs and videos taken during the trip being used by Landscape Adventure for marketing and promotional purposes on our website, social media, and printed materials. If you do not wish to be featured, please inform us in writing before departure.
13. Governing Law
These Terms and Conditions are governed by the laws of Nepal. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal.
